Terms and Conditions

(1) Ownership of the website

The website https://ibassottidiolivia.com (hereinafter referred to as the "Website") is owned by Federica Petronzio, with its registered office at Via Soriano 21/23 – 04023 Formia (LT), VAT number 03293140590, registered in the Business Register of Frosinone – Latina with the number LT – 325199. The Website is intended for the online sale of physical products.

(2) Applicable Law

2.1. Articles 45 to 67 “Consumer Rights” of Legislative Decree No. 206 of September 6, 2005 (Consumer Code) and Legislative Decree No. 70 of April 9, 2003 concerning electronic commerce regulate the sale of products and services through electronic means.
2.2. Every sales contract entered into by I Bassotti di Olivia di Petronzio Federica with the Customer will be governed and interpreted according to Italian law.

(3) Acceptance of the instructions provided for order completion and all general sales conditions.

3.1. The Customer, by placing an order according to the procedures outlined on the Site, declares to have taken note of all the instructions provided during the purchasing process and to fully accept the general sales and payment conditions set forth below.
3.2. The sales contract entered into between the Customer and I Bassotti di Olivia di Petronzio Federica is governed by these general sales conditions, together with the conditions related to order completion and the methods of delivery and payment for the goods.
3.3. I Bassotti di Olivia di Petronzio Federica invites buyers to carefully read these general sales conditions and to print and retain them on a durable medium for future reference.

(4) Order and Purchase

4.1. The products that the Customer can purchase are those available on the Site www.ibassottidiolivia.com as depicted on its Homepage and in its various sections, categorized by product type and described in the corresponding informational sheets, if available.

4.2. The products displayed on the site can be: “-available”, meaning they are in stock and therefore available for the Customer to order; “-not available”, meaning they are out of stock. In this case, the Customer will not be able to order the product but, if desired, may provide their email address to be informed if and when the product becomes available again;

4.3. To purchase products, the Customer must be registered on the site or access as a guest;

4.4. For delivery, I Bassotti di Olivia di Petronzio Federica uses national couriers. The Customer can choose the payment method at the time of purchase (PayPal and accepted credit cards);

4.5. I Bassotti di Olivia di Petronzio Federica confirms the acceptance of the order by sending an email to the email address provided by the customer when registering on the site or at the time of purchase;

4.6. The data contained in the order confirmation email are as follows: Order number and date, Product(s) quantity and price, Chosen payment method, Shipping costs, Total order amount;

4.7. The Customer is required to check that the details in the order confirmation email are correct and to immediately report any errors or omissions to I Bassotti di Olivia di Petronzio Federica;

4.8. I Bassotti di Olivia di Petronzio Federica reserves the right, at its sole discretion, to refuse the order.

(5) Prices

All sales prices published on the Site are inclusive of VAT.

(6) Exclusive Jurisdiction (Consumer Court)

In the event of a dispute regarding the interpretation, execution, and resolution of this distance selling contract, if the Customer is a final non-professional consumer (i.e., a natural person who does NOT purchase the products for use in their professional activity), the court of the place of residence or domicile of the consumer, if located in Italy, will have exclusive territorial jurisdiction (in accordance with Article 63 of Legislative Decree 205/2006).

(7) Validity and Modification of the General Sales Conditions

The present general sales conditions will remain valid and effective until they are amended and/or supplemented by I Bassotti di Olivia di Petronzio Federica through the publication of such changes and/or additions on the Site, at the internet address https://ibassottidiolivia.com/termini-e-condizioni/. The changes and/or additions will be effective from the moment of their publication.

Purchase Procedure

(1) Catalogues, Products, Prices

The catalog of products available on the Site is updated daily.
It may therefore differ from the catalog available at individual retail points that distribute products from I Bassotti di Olivia di Petronzio Federica.
The prices of the products indicated on the Site www.ibassottidiolivia.com may not coincide with those practiced by individual retail points that distribute the same products.
The prices set by I Bassotti di Olivia di Petronzio Federica and indicated on the Site may be changed at any time, even within the same day.

(2) Username e password

The purchaser may choose to register and obtain a Username and Password to place orders and access their “personal area” on the Site; in this area, details of each order and the data provided by the consumer during registration are displayed. Alternatively, the user can make a purchase and checkout as a “guest”; in this case, registration is not required.
The Username must be a valid email address.
The password must be at least 6 characters long, including one symbol and two numbers, and the system distinguishes between uppercase and lowercase letters.
If you forget your registered password, you do not need to register again; simply follow these instructions:

2.1 Have you forgotten your password?
If so (provided you remember at least the username), you need to follow this procedure: from the menu at the top right, click – Account – to open the Account page – click the link – Forgot Password? – to open a page requesting: enter your registration email address. The user will receive an email containing the “Password Recovery Procedure” (with a link to reset the password and access the screen to set a new password). After entering and confirming the new password, the user will normally have access to their personal area.

(3) Carrello

Each product you wish to purchase must be added to the “Cart” first. You can click “add to cart” under each product on a Category page, or by first opening the product itself and clicking “add to cart.”
Adding a product to the cart does not constitute a purchase and does not obligate you to buy.
You can view the contents of the Cart by simply clicking on the cart icon located at the top right of the page where each product category is listed. This will open a page showing the type and quantity of individual products added for purchase, where you can:
– modify or remove the product from the cart by clicking the appropriate button;
– view the shipping costs (shipping within national borders at a fixed cost of €10 for orders under €60, and free for orders over €60).

For shipments beyond national borders, additional shipping costs may apply.
If you want to examine other products to decide whether to select and add them to your Cart, you can continue browsing by viewing items according to categories of interest, which are always visible at the top of the page; alternatively, if you already know the brand and/or model of the desired item, simply enter it in the search menu on the Site, located at the top right of the page, next to the cart icon.
If you do not proceed further after adding one or more products to the Cart, the added products will remain in memory for thirty days (during which the cart will “update” automatically in case of price changes or removal of products from the catalog of I Bassotti di Olivia di Petronzio Federica). After this period, the cart will no longer contain any products.
If you wish to proceed with the purchase, you must click the “Proceed” button: you will be directed to an identification page where you will be asked to enter your details.
You can enter the cart and check its contents by clicking on the “Cart” text highlighted at the top right of the page.

Products that are completely sold out are directly removed and will no longer be visible.

(4) Pagamento

The Customer can opt for payment via PayPal and credit card;
all credit cards can be used;
In the case of payment by credit card, no additional cost will be charged.
When using credit cards, always enter the CVV2 CODE: otherwise, the order will be canceled.
For credit cards from the Visa and Mastercard networks, the CVV2 consists of the last 3 digits on the back of the card.

4.1 Possible request for an additional code:
It may happen that after entering the credit card details and CVV2, an additional code or other specific data must be provided.
This occurs because some banks require a particular procedure for online credit card authorization. In this case, you need to contact your bank for instructions on authorizing the credit card for online purchases.

4.2 Authorization for credit card charge:
When entering credit card details, the bank is requested to authorize the charge on the credit card.
Sometimes banks inform the customer via SMS: this means that the necessary amount for the purchase has been “reserved” and “blocked” on the credit limit; however, receiving the SMS does not equate to confirmation of the final charge.
The final charge occurs when, upon shipping the products, an SMS and an email are sent to the contact details provided by the customer at the time of the order, confirming from I Bassotti di Olivia di Petronzio Federica that the products have been handed over to the courier for transport; only at this point will the purchase amount be charged to the credit card.

4.3 Possible “genuineness check”:
It may happen that before handing over the ordered goods to the courier, the order paid with a credit card undergoes a “genuineness check” (a check to verify the actual ownership of the credit card) performed by the bank that issued the card.
If a “genuineness check” is initiated, the customer may be informed by I Bassotti di Olivia di Petronzio Federica via email.
The “genuineness check” usually takes 24 hours for orders paid with Visa and Mastercard credit cards.

Rights - Right of Withdrawal

(1) Content of the Right of Withdrawal

Articles 45 to 67 of Legislative Decree 206/2005 (Consumer Code) regulate sales of products made via the Internet. The Consumer Code recognizes the consumer’s right to withdraw from contracts or contractual offers, allowing them to return the purchased product and receive a refund of the amount spent. However, the right of withdrawal does not apply to products made to measure or clearly personalized or that, by their nature, cannot be returned or risk deteriorating or altering rapidly, nor does it apply to audiovisuals and software contained in originally sealed packages that have been opened by the consumer; it also does not apply to sealed products opened after delivery to the consumer that cannot be returned for hygienic reasons or health protection. In the case of withdrawal, the Customer is responsible for the diminished value of the goods resulting from handling that is not necessary to determine the nature, characteristics, and functioning of the products, such as when: – the original packaging is missing, and/or – integral elements of the goods are missing, such as: instruction manual, accessories, cables, and other similar elements. The right of withdrawal is recognized only to “Consumers,” defined as individuals who purchase goods not for purposes related to their professional, commercial, or business activities. Therefore, the right of withdrawal does not apply to “Professionals,” i.e., individuals and/or legal entities acting for their professional purposes. The Customer will bear the costs of returning the product.

(2) How and Within What Timeframe to Exercise the Right of Withdrawal

The Customer may withdraw within 14 (fourteen) days from the delivery of the goods or, in the case of services, from the conclusion of the relevant contract. Within this deadline, the Customer wishing to exercise this right must inform I Bassotti di Olivia di Petronzio Federica of their withdrawal in one of the following ways:
  1. a) Sending a registered letter with acknowledgment of receipt to the following address:

  1. b) Sending the withdrawal request via certified email (PEC) to ibassottidiolivia@pec.it.
Within 3 (three) working days from receiving the withdrawal communications, I Bassotti di Olivia di Petronzio Federica will send – to the Customer’s email address provided in the order or in their withdrawal request – the Return Authorization Number (NAR) identifying the case. The Customer, within 14 (fourteen) days of receiving the Return Authorization Number (NAR), must, at their own expense, return the product in its original packaging; the Return Authorization Number provided by I Bassotti di Olivia di Petronzio Federica must be indicated on it; in particular, the return must be made by shipping the product to the following address (or to the different address indicated in the email from I Bassotti di Olivia di Petronzio Federica communicating the NAR): I Bassotti di Olivia di Petronzio Federica, Via Soriano n. 21/23 – Cap 04023 Formia (LT). It is specified that the 14-day deadline for returning the product following the exercise of the consumer’s right of withdrawal is considered respected as long as the product is materially shipped within this period.

(3) How and Within What Timeframe the Refund of the Product Cost and Shipping Costs is Expected

I Bassotti di Olivia di Petronzio Federica, in accordance with Article 56 of Legislative Decree 206/05, will refund all payments received from the Customer and the costs of the original delivery to the Customer of the returned product following their withdrawal (except for additional costs arising from the possible choice of a type of delivery other than the least expensive standard delivery offered by I Bassotti di Olivia di Petronzio Federica) within 14 (fourteen) days from the date on which I Bassotti di Olivia di Petronzio Federica became aware of the exercise of the right of withdrawal by the Customer; the Customer will not incur any costs as a consequence of this refund (noting that the costs of shipping for the return of the product following withdrawal are, as stated, borne by the Customer). I Bassotti di Olivia di Petronzio Federica will have the right to withhold the amount due to the Customer for the refund until the product is received intact or until the Customer has demonstrated that they have shipped the goods; the earlier of the two will prevail. In the case of payment by credit card for the purchased products, I Bassotti di Olivia di Petronzio Federica will make the refund by reversing the transaction directly on the Credit Card. In the case of payment for the purchased products via PayPal, the refund will be made through a credit to the Customer’s account. In the case of payment by bank transfer, the Customer will receive a refund to the same account.

(4) Exercise of the Right of Withdrawal in the Case of Purchases Made via Financing

In the case of exercising the right of withdrawal from the purchase of a product made via a financing agreement, the latter will be immediately void. If the Customer has purchased multiple products with a single order via a financing agreement and wishes to withdraw from the purchase contract concerning one or more specific products, the Customer will be required to: – Inform I Bassotti di Olivia di Petronzio Federica of their intention to withdraw, specifying the product they wish to return as described above; – Receive from I Bassotti di Olivia di Petronzio Federica the indication of the new amount to be financed; – Communicate this amount to the consumer credit company via a toll-free number, requesting the opening of a new financing practice for the amount communicated by I Bassotti di Olivia di Petronzio Federica, for which the documents sent for the initial financing request will be considered valid; – Communicate in writing to I Bassotti di Olivia di Petronzio Federica the new reference number of the financing practice obtained, receiving from I Bassotti di Olivia di Petronzio Federica a new corresponding Return Authorization Number; – Return the product(s) subject to withdrawal using the new NAR. I Bassotti di Olivia di Petronzio Federica, upon receiving the returned product(s), will cancel the initial financing and issue a new invoice with updated amounts and products.

Rights - The Warranty

(1) Legal Warranty

All products sold by I Bassotti di Olivia di Petronzio Federica are covered by the 24-month legal warranty provided by Articles 128 to 135 of Legislative Decree 206/2005 (“Consumer Code”). The legal warranty consists of the responsibility for 24 months of I Bassotti di Olivia di Petronzio Federica, as the seller of the products, towards the consumer, understood as the individual who acts for purposes unrelated to any business, commercial, artisanal, or professional activity possibly carried out, for defects of conformity not detectable at the time of concluding the purchase contract, within the limits and with the procedures that will be summarized below. A product has a “defect of conformity” if, as provided in Article 129 of the Consumer Code: – it is not suitable for the use it is normally intended for; – it does not conform to the description or does not have the qualities promised by the seller; – it does not offer the qualities and performance typical of a good of the same type; – it is not suitable for a particular use desired by the consumer if not communicated to and accepted by the seller at the time of purchase. The report of the defect of conformity – which must manifest itself within 24 months from the delivery of the goods to be covered by the warranty – must be made within 2 months from the date of discovery. However, reporting is not necessary if the seller has acknowledged the defect or concealed it. Unless proven otherwise, defects of conformity that appear within 6 months from the delivery of the goods are presumed to have existed at that date. In the case of a defect of conformity, the consumer can first request, at their choice, the seller to repair the goods or replace them, without any cost in both cases, except where the requested remedy is objectively impossible or excessively costly compared to the other. In the case of I Bassotti di Olivia di Petronzio Federica, only replacement is provided, as repair is generally objectively impossible or excessively costly. Replacements must be made within a reasonable time from the consumer’s request; in the case of I Bassotti di Olivia di Petronzio Federica, the average time for returning the product to the consumer is 30 days. If within the maximum term of 60 days I Bassotti di Olivia di Petronzio Federica is unable to deliver the replacement product, the consumer may alternatively request one of the other remedies (contract termination, price reduction). In the case of a price reduction or contract termination with refund of the price, account is taken – to determine the amount due to the consumer – of the use of the good by the same.

(2) How to Exercise the Right to the Legal Warranty

A consumer who wishes to use the legal warranty must: – Report the defect found to I Bassotti di Olivia di Petronzio Federica in writing, by email to info@ibassottidiolivia.com, describing as clearly as possible the defect found in the product; – Note the Return Authorization Number (NAR) (which varies from case to case) that I Bassotti di Olivia di Petronzio Federica will provide; – Carefully pack the product for shipment, including accessories, the user manual, and anything else contained in the original packaging; – Clearly and legibly mark the Return Authorization Number (NAR) assigned by I Bassotti di Olivia di Petronzio Federica on the packaging. The logistics operator appointed by I Bassotti di Olivia di Petronzio Federica will then contact the consumer to arrange the pickup of the product.

(3) Additional Conventional Warranty from the Manufacturer

A “conventional warranty” refers to a non-mandatory warranty that the supplier of a particular product may provide in addition – never in place of – the legal warranty that is rightfully due to the consumer. The conventional warranty generally covers only the repair of the product for a limited period of time. The products sold by I Bassotti di Olivia di Petronzio Federica, unless otherwise specified to the consumer, come with only the legal warranty.

Delivery - Times and Costs

(1) Delivery Types

Deliveries are made using standard delivery methods within the national territory. 1.2. Standard delivery is performed at the address specified by the consumer on business days from 08:30 to 18:30, through the National courier Poste Italiane, the logistics operator appointed by I Bassotti di Olivia di Petronzio Federica [verify the carrier and its availability]. The expected delivery times start from the moment the goods are handed over to the courier, an operation that is carried out within a maximum of approximately 2 business days from the completion of the purchase by the Customer. Delivery times from the moment the goods are handed over to the appointed courier are generally 2 business days (except for force majeure events such as accidents, thefts from the transport vehicle, weather conditions); in exceptional cases, delivery times may extend to 7 business days for deliveries to islands or otherwise difficult-to-reach locations, or uncontrollable events for which I Bassotti di Olivia di Petronzio Federica cannot be held responsible.

(2) Delivery Costs

2.1. Delivery costs are standard and apply exclusively to shipments within the national territory for an amount of €10 (ten euros) for orders under €60. Shipments for orders over €60 are free of charge. 2.2. No additional cost is applied for deliveries to islands and difficult-to-reach locations. 2.3. Delivery costs amount to €25 for international shipments within the European Union.
